Federal Consistency Review Process

Is the proposed activity within the Coastal Area? Click here for assistance	no	Consistency Review by the Department of State is NOT required.

Does the proposed project require authorization (e.g. permit from a federal agency)?	no	Federal consistency review is NOT required by DOS. (State agencies click here for information regarding State Consistency.) (Federal agencies click here for information pertaining to federal consistency for direct actions.)

Does the proposed project qualify for a Nationwide Permit (NWP) from the Army Corp of Engineers?	yes	Click here to determine if federal consistency review is required by the DOS.

	Complete and sign the Federal Consistency Assessment Form (FCAF). (Applicants in New York City may submit a NYC CAF in lieu of an FCAF). The coastal boundary map is available to help you complete Section C of the FCAF.

	Compile all the necessary data and information. Click here for a complete list.

	Submit a copy of a completed and signed FCAF, along with the above necessary data and information to the DOS at the same time as the federal application is filed with the federal agency.

	The DOS can begin its consistency review of the proposed project once all of the necessary data and information is received. After reviewing the submitted material, the DOS will notify the applicant if any additional information is required to complete its consistency review for the proposed project.

	DOS will notify the applicant and the federal agency once a decision has been made regarding the consistency of the proposed project with the New York State Coastal Management Program.
