Welcome to the Consistency Review Information Center! This page has been designed to provide you with information about the consistency review process and assist you in determining if a proposed project requires consistency review by the Department of State in order to help get your project implemented as quickly, efficiently, and economically possible.

Is Consistency Review required for my proposed project?

The following links contain information designed to assist in determining if consistency review is required for a proposed project. Please see the individual bullet which describes the nature of your project.

Federal Permits/Authorizations (for projects requiring federal permits or authorizations, such as U.S. Army Corps of Engineers Nationwide Permit Applications)
Federal Funding (for projects involving applications for federal funding)
Federal Agency Actions (for activities being undertaken directly by a federal agency)
State Agency actions (State consistency only pertains to actions undertaken by State agencies. This section is not applicable for projects undertaken by private individuals and organizations, or federal agencies.)

Consistency Review and U.S. Army Corps of Engineers Permits

The most common federal activity reviewed for consistency with the State coastal policies are U.S. Army Corps of Engineers (USACE) Nationwide Permit applications. Since activities authorized under nationwide permits are considered to have minimal effects, DOS has routinely concurred with many USACE nationwide permits. Therefore, many activities which would be undertaken under nationwide permits do not require consistency review by DOS.

Coastal Consistency Interactive Map

The DOS has created the Coastal Boundary Map to help you see whether or not a proposed project is located within the NYS Coastal Area or any designated Special Management Areas. This information will help you determine if consistency review applies or if there are additional resources or considerations to consider for a proposed project.
