Here at the New York State Department of State Division of Consumer Protection, our mission is to provide the necessary steps to get your life back on track after identity theft.  Representatives will work with you to help restore the credibility of your name.  Our experts will assist you through the delicate process of identity theft mitigation, by providing one on one support, and connecting you to every resource available to us.  We realize that being the victim of identity theft is a very sensitive matter, and thus, we will do our best to make this as comfortable a process as can be.

The Division of Consumer Protection has a number of customer assistance representatives that can be reached by calling 1-800-697-1220. Our weekly business hours are 8:30 AM to 4:30 PM, Monday-Friday.
The following is a breakdown of how this process is handled.

Educating the caller
The first step taken by our consumer advisors is to inform you that you must first file a police report.  Thereafter, we advise you to place a fraud alert and a credit freeze on your credit history immediately.  It is also suggested that you obtain copies of your credit reports to ensure there are no inaccuracies.  If any bank account or credit card has been accessed, your initial plan of action is to contact your bank and credit card company and immediately shut down those accounts. 

Addressing the problem
After you have obtained your credit reports and attempted to resolve any errors yourself, we provide voluntary mediation by contacting the credit bureaus on your behalf in order to get the errors corrected you were unable to resolve.  You can fill out an electronic consumer complaint form found on our website at https://www.dos.ny.gov/consumerprotection/form/complaintform.asp

Stopping the collection calls
We also contact any debt collectors on your behalf to assist you with getting the debt collector to discontinue their collection efforts for erroneous debts incurred as a result of the identity theft.
