• Recent amendments to the General Business Law will impact the licensing terms for all Appearance Enhancement and Barber Operator and Business licenses. Currently, all Appearance Enhancement and Barber Operator and Business licenses are valid for a period of two years. As a result of these amendments, all Appearance Enhancement and Barber Operator and Business Licenses issued or renewed that will be effective on or after July 1, 2011 will be valid for four years.  Accordingly, the fees will reflect a four-year term. • Decision Regarding Laser Devices/ Appearance Enhancement Licensees
ALBANY, N.Y. (January 28, 2010) -- The Department issued a decision regarding the use of laser devices by appearance enhancement licensees. This decision held that laser and non-ablative radio-frequency procedures, including Thermage, are the practice of medicine and beyond the scope of practice for appearance enhancement licensees. Please note that laser hair removal services may be offered in licensed appearance enhancement businesses by licensed cosmetologists and estheticians provided that there is a clear, distinct disclaimer that the practice of laser hair removal is not regulated in any way by the Department of State. The use of a separate facility for the practice of laser hair removal is also acceptable provided that the same disclaimer is provided.

• Effective December 22, 2011, the General Business Law requires that an automobile broker business, as defined by statute, maintain a surety bond in the amount of $75,000 to be filed with the Department of State. It is the responsibility of automobile brokers to understand Article 35-B of the General Business Law.

§ 199.1 Label Requirements for new and used bedding.

In addition to the requirements set forth in § 389-a and § 389-b of the General Business Law, each label for new or used bedding shall identify, as appropriate, the name of the seller of the used bedding, the name of the manufacturer of the new bedding, the name of the manufacturer of the used bedding, or the name of repairer, renovator or rebuilder of used bedding. Each label shall also indicate the method used to sanitize the used bedding. More

Supervisory Appraiser Requirements – Effective July 1, 2013

Effective July 1, 2013, all individuals in the position of “Supervisory Appraiser” must meet or exceed the minimum qualifications set forth by the Appraiser Qualifications Board (AQB).  

Persons wishing to become a supervisor of one or more appraiser assistants must provide evidence of having a general or residential appraiser certification in New York State and must have been state certified for a minimum of three years.

An individual who has had a real estate broker, salesperson or an appraisal license or certification revoked or suspended within the last three years is ineligible to receive instructor approval from the Department and is ineligible to supervise appraiser assistants. 

The Supervising Real Estate Appraiser shall be responsible for the training and direct supervision of the appraiser assistant. Supervisory Appraisers may not supervise more than three trainee appraisers at one time.  A trainee appraiser is permitted to have more than one Supervisory Appraiser.

All appraisers who will be a “Supervisory Appraiser” and meet the qualifications must submit a Real Estate Appraiser Instructor and Supervisory Appraiser application (DOS-1491) to our office. 

 


Real Estate Brokers and Salespersons

Effective January 1, 2013, revisions to Article 12A of the Real Property Law have amended the fees for performing the "Termination of a Salesperson or Associate Broker" and "Change of Association" transactions. The new fees are as follows:

• Termination Fee will change to $0 for each transaction
• Change of Association Fee will change to $20 per transaction

The online Real Estate System, eAccessNY, has been modified to incorporate these revised fees effective January 1, 2013. The statute continues to mandate that each broker perform these transactions in a timely manner.

• Disclosure Regarding Dual Agency in Real Estate Relationships - Effective January 1, 2011
Effective January 1, 2011, the Real Property Law will be amended. The statutory amendments will permit real estate licensees to obtain informed, advance consent to dual agency relationships and will require agents to provide agency disclosure statements to parties involved in cooperative apartment and condominium unit transactions.

• Online Renewal for Real Estate Licenses:
Beginning February 1, 2010, Licensees will no longer be sent a paper renewal in the mail. In accordance with New York's Green Initiative, the Division of Licensing Services will be requiring that all real estate licensees renew their licenses online. When a license is due for renewal, the licensee will be notified in two ways: a postcard reminder will be sent to the licensee's business address and an email reminder will be sent to the email address provided in the licensee's eAccessNY account. In addition, brokers will be included in the email reminders(a "cc" copy) for any salespersons and associate brokers who are employed by their office. Both of these renewal reminders will include instructions on how to renew a license online utilizing eAccessNY.

The online renewal process is a much quicker and more efficient process. Online renewal applications that meet the requirements will be approved immediately and licensees will receive their License and Photo ID Card within two to three weeks.

Instructions for Completing an Online Renewal:
To renew your license online you must have an active eAccessNY account and follow the directions below:

• Go to the Department of State website, www.dos.ny.gov, and select the eAccessNY link (to the right of the screen)
• Select "access" link under item 3, "Access My Account" and log into your account
• Select list of licenses/select the license number you wish to renew
• Select the "Renew License" link and complete the online application

If you have not yet activated your eAccessNY account, NOW is the time. Please email us at eAccessNY@dos.ny.gov to obtain a password for your account.
