Amendment to Telemarketing Law

Effective November 12, 2012, the General Business Law was amended to require all telemarketers doing business in New York to register with the Department of State. These changes will allow the Department more enforcement authority for violations of the law.

In addition, these amendments prohibit all telemarketers doing business in New York from delivering prerecorded messages by telephone call to customers without express consent from the recipient and will require a mechanism that allows the consumer to automatically add the telephone number called to that caller’s do-not-call list.
