Overview of the Educational Services Unit
The Educational Services Unit (ESU) administers the code enforcement Basic Training Program (BTP) promulgated by Executive Law §376-a and established by 19 NYCRR Part 1208.  This program provides training to individuals who wish to become a certified Code Enforcement Official (CEO) or a certified Building Safety Inspector (BSI).  Because of limited room capacity, priority seating in the BTP is reserved for local government (cities, towns, villages, and counties) CEOs and BSIs, and state agency designated Code Compliance Managers and Code Coordinators.  Where space allows, design professionals, contractors, and the general public may be admitted into the program.

In general terms, a certified CEO may perform any code enforcement activity.  Some of these duties include, but are not limited to, conducting fire safety and/or property maintenance inspections of existing buildings, review and/or approval of plans incidental to the issuance of a permit for the construction or alteration of buildings, and construction inspections performed during and/or upon completion of the construction or alteration of buildings (19 NYCRR 1208-1.2(e) and (h)(2)).  The duties that a certified BSI may perform are limited to fire safety and property maintenance inspections of existing buildings (19 NYCRR 1208-1.2(c) and (h)(1)).

The ESU is also responsible for creating and administering In-Service training (continuing education) courses for BSIs and CEOs, and for reviewing and approving continuing education courses created and provided by Adjunct instructors (19 NYCRR 1208-1.2(a))

Advanced In-Service Training
The Department of State occasionally requires Certified Building Safety Inspectors (BSIs) and Certified Code Enforcement Officials (CEOs) to receive Advanced In-Service training.  This training typically relates to amendments to the Uniform Code or Energy Code, changes in law, or other matters that necessitates specific training.  The requirement for Advanced In-Service training is established by 19 NYCRR 1208-3.4.

The New York State Fire Prevention and Building Code Council recently adopted an updated version of the Uniform Fire Prevention and Building Code (the “Uniform Code”).  The Department of State is requiring Advanced In-Service training on this updated code to ensure that the code enforcement community understands how to apply it.  This mandatory training also addresses certain code requirements that relate to identifying and addressing structures unfit for human occupancy.  Some of these requirements are new, whereas others existed in the past version of the Uniform Code.  BSIs and CEOs must complete the Advanced In-Service training by December 31, 2020.

The Advanced In-Service training requirements are as follows:

  • BSIs must successfully complete 3-hrs of training as specified below:
    • 2020 Advanced In-Service – Part 1, Course #49-0125, 2-hrs Topic 1
    • 2020 Advanced In-Service Exam, Course #49-0127, 1-hr Topic 1
  • CEOs must successfully complete 5-hrs of training as specified below:
    • 2020 Advanced In-Service – Part 1, Course #49-0125, 2-hrs Topic 1
    • 2020 Advanced In-Service – Part 2, Course #49-0126, 2-hrs Topic 2
    • 2020 Advanced In-Service Exam, Course #49-0127, 1-hr Topic 1

The 2020 Advanced In-Service courses (#49-0125 and #49-0126) will be provided at code enforcement conferences during 2020.  Click here for the 2020 conference training schedule.  These courses will also be available online through the Statewide Learning Management System (SLMS).  The Division of Building Standards and Codes (DBSC) will email those BSIs and CEOs who subscribe to the Division’s mailing list and notify them when the online courses are available.  The DBSC will also post this information on its website.

The 2020 Advanced In-Service Exam (Course #49-0127) is an online exam that will cover material contained in Chapter 1 of the 2020 Fire Code of New York State.  BSIs and CEOs will be permitted to use the code books (electronic or printed version) when taking the exam.  Individuals may take the exam as many times as they need to pass.  The exam will be available on SLMS prior to May 12, 2020.  The DBSC will email those BSIs and CEOs who subscribe to the Division’s mailing list and notify them when the exam will available.  The DBSC will also post this information on its website.

Notice of Required Advanced In-Service Training for

Code Enforcement Officials and Building Safety Inspectors

In accordance with 19 NYCRR §1208-3.4, the recently adopted revisions of the New York State Uniform Fire Prevention and Building Code (Uniform Code) and New York State Energy Conservation Construction Code (Energy Code) warrant the specific advanced in-service training described below.

In accordance with 19 NYCRR §1208-3.4, the following courses developed by the Department of State are deemed to be advanced in-service training courses:

  • 2020 Advanced In-Service – Part 1 (Course #49-0125)
  • 2020 Advanced In-Service – Part 2 (Course #49-0126)
  • 2020 Advanced In-Service Exam (Course #49-0127)

The 2020 Advanced In-Service – Part 1 (Course #49-0125) shall be 2 hours in duration and shall provide 2 hours of training credit in Topic Area 1 (Code Enforcement and Administration).

The 2020 Advanced In-Service – Part 2 (Course #49-0126) shall be 2 hours in duration and shall provide 2 hours of training credit in Topic Area 2 (Uniform Fire Prevention and Building Code).

The 2020 Advanced In-Service Exam (Course #49-0127) shall be an examination covering the topics covered in 2020 Advanced In-Service – Part 1 (Course #49-0125). The examination will be untimed. Successful completion of the examination shall be deemed to provide 1 hour of training credit in Topic Area 1 (Code Enforcement and Administration).

Building Safety Inspectors: In accordance with 19 NYCRR §1208-3.4, Building Safety Inspectors must successfully complete the following advanced-in-service training courses, totaling 3 hours of training, by December 31, 2020 to maintain certification:

  • 2020 Advanced In-Service – Part 1 (Course #49-0125)
  • 2020 Advanced In-Service Exam (Course #49-0127)

Building Safety Inspectors are required to complete a total of 6 hours of in-service training in calendar year 2020 to maintain certification. Timely completion of the required advanced in-service training described above shall count as 3 of the required 6 hours.

Code Enforcement Officials: In accordance with 19 NYCRR §1208-3.4, Code Enforcement Officials must successfully complete the following advanced in-service training courses, totaling 5 hours of training, by December 31, 2020 to maintain certification:

  • 2020 Advanced In-Service – Part 1 (Course #49-0125)
  • 2020 Advanced In-Service – Part 2 (Course #49-0126)
  • 2020 Advanced In-Service Exam (Course #49-0127)

Code Enforcement Officials are required to complete a total of 24 hours of in-service training in calendar year 2020 to maintain certification. Timely completion of the required advanced in-service training described above shall count as 5 of the required 24 hours.
