The State Fire Prevention and Building Code Council [Code Council] is empowered to adopt higher or more restrictive standards [MRLS] upon the recommendation of local governments in accordance with Section 379 of the Executive Law. Within thirty days of such enactment or adoption of a local law or ordinance pertaining to construction, the chief executive officer, or if there be none, the chairman of the legislative body of such local government, shall notify the Code Council, and shall petition the Code Council for a determination of whether such local laws or ordinances are more stringent than the standards for construction in the Uniform Fire Prevention and Building Code [Uniform Code].
This list is compiled from responses to a questionnaire which was sent to local governments regarding More Restrictive Local Standards. Listed below are local laws or ordinances that have been reported to the Code Council as imposing higher or more restrictive standards, and have been adopted by the Code Council in whole or in part.
Note: The asterisk * denotes that the local government approved the local law or ordinance prior to January 1, 1984, and subsequently the State Fire Prevention and Building Code Council approved such adoption as a higher or more restrictive local standard.
