Division of Building Standards and Codes

Ensures the Health, Safety and Resilience of the Built Environment for all New Yorkers. The Division of Building Standards and Codes (BSC) administers the mandatory statewide Uniform Fire Prevention and Building Code (Uniform Code) and State Energy Conservation Construction Code (Energy Code).  The Division provides a variety of services related to the Uniform Code and Energy Code.  It provides technical assistance, administers variances, delivers educational courses, oversees the enforcement practices of local governments and serves as secretariat to the State Fire Prevention and Building Code Council.  The Albany Central Office and eleven regional offices throughout the state provide regional service to elected officials and local code enforcement personnel regarding general requirements for code enforcement.  The Division program was created by Chapter 707 of the Laws of 1981.  The New York Legislature enacted Article 18 of the Executive Law, directing the formulation of a Uniform Fire Prevention and Building Code (Uniform Code).  The Uniform Code is designed to cover new construction, building rehabilitation, fire safety, and housing maintenance.

Rule Making Activity

Notices of Proposed Rule Making

Notice of Proposed Rule Making - additional amendments to the New York State Uniform Fire Prevention and Building Code (the Uniform Code). An amended and updated version of the Uniform Code became effective on October 3, 2016. On March 21, 2017, the Department of State filed a Notice of Proposed Rule Making for a rule that will make additional amendments to the Uniform Code. The proposed rule will also make corresponding changes to regulations relating to placement of signs on buildings that utilize truss-type construction (19 NYCRR Parts 1264 and 1265). The Notice of Proposed Rule Making will be published in the State Register on April 5, 2017. On and after April 5, 2017, the April 5, 2017 edition of the State Register can be viewed by clicking the "April 5" link at http://www.dos.ny.gov/info/register/2017.html. The Notice of Proposed Rule Making includes the full Regulatory Flexibility Analysis, the full Rural Area Flexibility Analysis, the full Statement Regarding Job Impact Statement, a summary of the Text of the proposed rule, and a summary of the Regulatory Impact Statement for the proposed rule. Notice of Proposed Rule Making - additional amendments to the State Energy Conservation Construction Code (the Energy Code). An amended and updated version of the Energy Code became effective on October 3, 2016. The version of the Energy Code that became effective on October 3, 2016 includes several references to a publication entitled the "2016 Uniform Code Supplement." The proposed amendment to the Uniform Code discussed in the preceding paragraph will substitute a new publication, the "2017 Uniform Code Supplement," in place of the 2016 Uniform Code Supplement. On March 21, 2017, the Department of State filed a Notice of Proposed Rule Making for a rule that will make amendments to the Energy Code. The proposed amendments to the Energy Code will change existing references to the 2016 Uniform Code Supplement to references to the 2017 Uniform Code Supplement. The Notice of Proposed Rule Making will be published in the State Register on April 5, 2017. Notice of Adoption - Notice of Adoption and Amended Notice of Adoption - A rule to update the provisions of the State Energy Conservation Construction Code was adopted on March 9, 2016. That rule was amended by an amended rule adopted on August 25, 2016. The updated version of the State Energy Conservation Construction Code will become effective on October 3, 2016.
